🔵 Provision 1: Retired SC Judge cannot practice in any court in India
👉 Source: Article 124(7) of the Indian Constitution
“No person who has held the office of a Judge of the Supreme Court shall plead or act in any court or before any authority within the territory of India.”
🔹 Iska matlab:
Ek retired Supreme Court judge vakalat nahi kar sakta, yaani kisi bhi case me as a lawyer appear nahi kar sakta — na Supreme Court me, na High Court me, na kisi tribunal ya authority ke samne.
✅ Yeh restriction lifetime hoti hai.
📌 Reason: Yeh provision banaya gaya taaki judiciary ki impartiality aur dignity bani rahe, aur retired judge ka influence misuse na ho.
🟢 Provision 2: Retired SC Judge ko appoint kiya ja sakta hai SC me (temporary)
👉 Source: Article 128 of the Indian Constitution
“The Chief Justice of India may at any time, with the previous consent of the President, request a retired judge of the SC or HC to sit and act as a judge of the SC for any temporary period.”
🔹 Iska matlab:
Retired judge ko dubara judge ki tarah bulaaya ja sakta hai — not as a lawyer but as a judge only for a short period.
✅ Yeh only with the consent of the President and on request of the CJI hota hai.
📌 Purpose: Jab SC me pendency zyada ho, aur workload manage karne ke liye additional judicial help chahiye.
Sochiye ek army officer retire hone ke baad kisi private army ke liye kaam nahi kar sakta, lekin emergency me wapas army me bulaaya ja sakta hai. Wahi logic yahaan bhi hai.
